    Competition Terms and Conditions

    Information on eligibility and how to enter this competition (the "Competition") forms part of these Terms and Conditions. Entry into this competition shall be deemed to be an acknowledgement and acceptance of these terms and conditions.

    1: THE PROMOTER

    Tennis Australia Ltd, (ABN 61 006 281 125) trading as Tennis Australia, Melbourne Park, Batman Avenue, Melbourne, Victoria, 3000.

    2: WHO MAY ENTER AND HOW TO ENTER

    • Entrants can enter by posting a caption for selected daily photos at www.australianopen.com, as nominated by the Australian Open website team.
    • The prize can only be awarded to entrants who are over 18 years of age.
    • Multiple entries are permitted.

    The competition is not open to:

    • employees of, or contractors to, the Promoter, or any of its agencies involved with this competition;
      or
    • immediate family members of such employees and contractors.

    3: THE PRIZE

    • The Prize includes:
      • 1 copy of the Australian Open picture book The World's Biggest Stage (value AUD$30)
      • 1 Australian Open t-shirt (value AUD$35).
      Total prize value is $65.
    • The prize is not transferable, exchangeable or redeemable for cash.

    4: COMPETITION DATES

    The Competition will run from 9.00am on 17 January 2010 to 5.00pm on 1 February 2010 AEDT. Entries in respect of each daily caption must be submitted by 6pm on the following day. Any entries received by Tennis Australia after this time are ineligible for entry into that day's Competition and no responsibility will be accepted by Tennis Australia for lost, late or misdirected entries.

    5: THE DRAWS

    The daily Competition winner will be announced by 8pm on a daily basis ("the Draw"). This is a game of skill and chance plays no part in determining the winner. The prize winners will be determined by a panel of 3 www.australianopen.com website producers, who will determine the best entry (the "Prize Winner"). The Promoter's decision and all matters pertaining to this promotion will be final. No correspondence will be entered into.

    6: NOTIFICATION AND COLLECTION OF PRIZE

    • The Prize Winners will be published on the Australian Open 2010 official website each day (www.australianopen.com) and will be notified by email. The prize will be posted to each Prize Winner via registered mail (domestically) or airmail (internationally) within 14 days of the relevant Draw.

    7: PRIVACY

    Tennis Australia requires that information to enter you into the competition and provide you with relevant information related to the competition. In addition, we may use your personal information to advise you of promotions, events, special offers and other like activities offered by Tennis Australia or its stakeholders except where permitted or required by law, or where your consent is obtained, this information will not be disclosed to third parties.

    Entrants are able to access personal information which they provide as part of their entry via the Promoter upon reasonable notice.

    8: PUBLICITY

    Entry into the Competition constitutes permission for the Promoter to use a winner's entry, name, suburb and state of residence, for promotional purposes including but not limited to uploading onto Tennis Australia's TennisWorld newsletter and its websites without compensation or notice unless otherwise prohibited by law.

    9: DISCONTINUATION AND DISQUALIFICATION OF THE COMPETITION

    • The Promoter reserves the right to discontinue the competition at any time and at its sole discretion may cancel, terminate or modify the competition.
    • The Promoter reserves the right, in its sole discretion, to disqualify any individual:
      • for tampering with the entry process
      • if the Promoter becomes aware that the entrant does not own, or have full legal authority to authorise the use and reproduction of any photograph that they submit, or
      • for otherwise acting in violation of these terms and conditions.

    10: EXCLUSION OF LIABILITY

    • The Promoter takes no responsibility for the loss of prizes due to incorrect or imprecise delivery or contact details provided by an entrant.
    • The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods or services offered as prizes.
    • The Promoter is not responsible for losses associated with any change to the value of any prizes.
    • To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained to personal property and including, but not limited to consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangements for supply, or the supply, of any goods or services by any person to the prize winner(s) and where applicable, to any persons accompanying the winner.
